We are seeking an Attorney (Marketing) on a contract basis to support our Customer's business needs. This role is hybrid in Mountain View, CA.

Responsibilities:

  • Provide legal counsel and ensure regulatory compliance with all marketing materials related to lending, including but not limited to, print, radio, and social media.
  • Review a wide variety of submitted marketing materials and provide timely and accurate legal advice, including reasons for requested changes and suggestions where necessary.
  • Identify, assess, and mitigate lending marketing compliance risks related to marketing and social media initiatives.
  • Review all lending marketing, social media, and sales materials - diplomatically and succinctly communicate legal concerns and required edits; explain the regulatory basis for the changes; and recommend creative alternatives to ensure content is legally compliant.
  • Provide legal guidance on compliant execution of lending marketing initiatives during the planning and creation process.
  • Provide legal counsel on the development and launch of new and innovative lending products, ensuring all marketing materials adhere to regulatory requirements.
  • Evaluate and enhance the current processes, and work with key stakeholders to ensure that advertising, marketing, web presence, and social media communications for lending products meet or exceed regulatory expectations.
  • Per regulatory guidelines and company policies, retain all approved lending materials according to established policies and procedures.
  • Prepare for exams and audits with respect to lending marketing communications.
  • Interact with internal employees, marketing specialists, and management to resolve legal and compliance findings related to lending marketing.
  • Work with Legal, Compliance, and business teams to implement regulatory changes that impact lending marketing.
  • Serve as the primary day-to-day legal/compliance partner for the lending marketing team as well as partner compliance teams (as it relates to lending marketing), helping them to execute direct mail, digital marketing, print, multichannel, and social media initiatives with appropriate content and required disclosures.

Skills and Qualifications:

  • J.D. degree from an ABA accredited law school or meet the requirements for legal education in a foreign country and membership in good standing with at least one US State Bar.
  • 5-10 years’ professional legal experience reviewing marketing materials within a regulatory or compliance function for financial services, specifically lending.
  • Deep subject matter expertise navigating regulations related to financial services, particularly TILA/Reg Z, ECOA, FCRA, Fair Lending, UDAAP - as well as working knowledge of TCPA and CAN-SPAM.
  • Preferred knowledge of financial services regulation, including but not limited to RESPA, SAFE Act, and others.
  • Ability to interpret laws/regulations and provide legal advice to business teams.
  • Excellent communication, interpersonal, and writing skills.
  • Strong organizational skills and attention to detail.
