Job description
The Mom Project is excited to support Etsy with their search for an experienced Legal Counsel, Marketing and Product, to join their team on a contract basis.
This role is part of a highly collaborative 3-lawyer Marketing Legal team, which itself is part of a larger Product-Marketing-Paments Legal team. It supports teams/projects in all markets across Marketing/PR/Products at Etsy, and reports to the head of Marketing Legal. To be successful in this role, the Counsel, Marketing and Product will have spent time advising marketing, PR and product teams as they design groundbreaking campaigns, communications and products, balancing commercial, marketing (both online and offline), compliance and privacy concerns. You are eager to answer new questions, tackle uncharted problems, and work with business teams to meet the needs of our dynamic environment. You also have experience balancing sound business and legal judgment and know how to counsel a wide range of clients on commercial contract strategy, from start to finish. You are skilled at drafting and negotiating complex agreements and licenses, as well as advising on marketing, intellectual property and partnerships. You’ll be expected to not only issue spot but problem solve, end to end on a project. You are comfortable working on a highly collaborative team with diverse experience. You should understand and be enthusiastic about Etsy’s business and mission as a global marketplace for creative entrepreneurs.
About The Role
As Counsel, Marketing and Product, you will be a key advisor to Etsy’s marketing, product, engineering teams and will provide transactional legal support to Etsy’s growing global business.
You will be responsible for:
- Reviewing, drafting and negotiating a wide range of US & international commercial agreements (in particular, negotiating indemnities, limitations of liability, intellectual property rights, SAAS agreements, marketing and ad tech agreements, etc).
- Working with product and marketing teams at Etsy as they design groundbreaking products and tools, balancing commercial, marketing (both online and offline), compliance and privacy concerns.
- Spot and solve problems on end-to-end projects.
- Helping follow, enhance and develop scalable processes for all stages of the contract lifecycle.
- Working with a global focus.
- Working with internal partners, others within legal, and outside counsel, through clear communication and effective project management.
- Answer questions, tackle uncharted problems, and work with business teams to meet the needs of our dynamic fast-paced environment.
- Balance sound business and legal judgment and counsel a variety of clients on commercial contract strategy, from start to finish.
- The most important quality for success on the Etsy legal team is good judgment. Knowing when to say “no”, “yes” or “maybe, but...” and know when to escalate. You are mindful that the company is your client, and you are savvy in your advocacy for and protection of your client.

Requirements
Must-Haves:
- JD and admitted to a state bar (preferably NY or CA) and qualified to work in-house in New York.
- 3+ years experience, at a law firm and in-house, dealing with issues related to product development and/or marketing for tech and e-commerce companies.
- You have handled a portfolio of technology, marketing, operational and commercial agreements, and have developed deep knowledge in some areas.
- Experience being the primary point of contact with clients, and taking the lead in managing the legal side of a project.
- The ability to speak to technical experts or business leaders in plain English, without legal jargon.
- Passionate about clearly articulating risk and strategies to mitigate risk to clients and executives.
- Excellent business, negotiation and presentation skills. You should also be able to analyze and communicate information into a simple, effective message to others.
Nice-to-Haves
- 3+ years of in-house, experience dealing with issues related to product development and/or marketing for tech and e-commerce companies.
Hours and Location
- 100% Remote for US based candidates
- 32 hr/week schedule
